1. Acceptance of Terms

By accessing or using GMBhelper.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

GMBhelper.ai is a software-as-a-service platform that helps businesses manage their Google Business Profiles. Our services include, but are not limited to:

• AI-powered review response generation and management
• Business photo uploading and management
• Google Business Profile post creation and scheduling
• Listing optimization and audit tools
• Multi-location management for agencies

3. Accounts & Eligibility

To use the Service, you must create an account using Google OAuth. You must be at least 18 years old and have the legal authority to enter into these terms. You are responsible for maintaining the security of your account and for all activities that occur under your account.

You agree to provide accurate and complete information during registration and to keep your account information up to date. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription & Billing

GMBhelper.ai offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Subscriptions are billed monthly through Stripe
• All new paid subscriptions include a 3-day free trial
• You may cancel your subscription at any time from the Settings page
• Cancellation takes effect at the end of the current billing period
• Refunds are handled on a case-by-case basis at our discretion
• We reserve the right to change pricing with 30 days' notice

5. Google API Usage

The Service connects to your Google account to manage your Google Business Profile. By using the Service, you:

• Authorize us to access and modify your Google Business Profile data on your behalf
• Acknowledge that we comply with the Google API Services User Data Policy
• Understand that you can revoke access at any time through the Connections page or your Google account settings
• Accept that service availability depends on Google API availability and may be subject to interruptions

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Post fake, misleading, or spam content to Google Business Profiles
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to manage profiles you are not authorized to manage
• Resell or redistribute the Service without our written consent

7. AI-Generated Content

The Service uses artificial intelligence to generate review responses and business content. While we strive for accuracy and quality, you acknowledge that:

• AI-generated content may require review and editing before publishing
• You are solely responsible for all content published to your Google Business Profile
• We do not guarantee that AI-generated content will meet specific quality standards
• AI suggestions should be treated as drafts, not final content

8. Intellectual Property

The Service, including its design, code, features, and branding, is the property of GMBhelper.ai and is protected by intellectual property laws. You retain ownership of all content you create and publish through the Service. By using the Service, you grant us a limited license to process and display your content as necessary to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, GMBhelper.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

10. Indemnification

You agree to indemnify and hold harmless GMBhelper.ai, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data after 30 days
• Provisions that by their nature should survive termination will remain in effect

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by email notification. Your continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These Terms of Service are governed by and construed in accordance with applicable law. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
